I have another thread asking about making a claim against a McKenzie friend, in the small claims court, for work not done. I have decided to make the claim but I wish to ask what is the current situation in case the court rejects my claim. Are there likely costs that the respondent can make, such as for time or other costs? It is mot likely that he will hire a solicitor, but are there cases when somebody does and then claim his costs if they win?
Is it still the case that it is necessary to file the claim in the local court of the respondent?
Is it necessary to file all the documented evidence with the claim or will the court ask for it (or give the chance to file more, depending on the response by the respondent?)
