  • The Financial Ombudsman

I had a case with the above which took two years from making a complaint to a decision being made. After making a complaint, an adjudicator was assigned who attempted to make me give up based on his initial assessment. I insisted that the case be referred to an actual ombudsman and it took almost two years for an ombudsman to actually get involved. Once the ombudsman became involved, I again felt that they wanted me to give up, so much so, they made a decision without fully considering my actual legal rights. Needless to say, the ombudsman did not find in my favour, having made a provisional decision without requesting the other party to respond in accordance with law. It was only after I pointed out to the ombudsman that the other party had to respond as required by the law that the ombudsman requested the other party to do so. Because the other side were not compelled to respond since the ombudsman had already advised them of his provisional decision, the other side did not respond and the matter concluded with the case being not found in my favour. The ombudsman had the audacity to ask me whether I accepted his decision and, needless to say, I chose not to accept. Basically, the whole process was an entire waste of time simply because the ombudsman failed to fully consider all the aspects of the case and prejudiced my claim by not acting in accordance with the law.
