Hi, I am in dispute with a trader and have had 3 independent surveys and the manufacturer says it hasn't been installed correctly fitting a pump to a toilet is not required or best practice, I now find myself after 12 months going through the small claims courts for reimbursements of costs of putting it right which was £2000, I'm also claiming £1200 for compensation for my time spent/wasted dealing with this issue over 35 hours and 14 months, probably more and also this was during and extremely distressing time dealing with my father in law dying from cancer over 4 months of dialogue and stress. We have had mediation which hasn't resolved it and as we both want to supply an expert in the claims court and I have been asked to meet the judge at the small claims court as an interim stage. I believe we are not being unreasonable for this to be paid by the trader and be compensated as he has refused to come back or after offering an independent survey never supplied one. His offer of £285 in clearly not acceptable and wondered if anyone has any words of wisdom before taking the final step and paying court fees. He has a no win no win solicitor and it seems unfair for me to not be able to claim back any legal costs. I feel we have a strong case. I have seen the trader around the corner at a job near me and I'm so tempted to inform his customers of how he treats his customers, Can I ask is this wise at this stage of proceedings or perfectly fair as I am just stating the facts?. Any advice and indeed legal advice would be welcomed at this time based on this scenario, Many thanks.
