  • Def letter of claim

Hoping for some advice. In 2016 I bought a static caravan for cash. In 2017 I was told that they wouldn’t rent it out because it was too old, I then bought another van on credit and part exchanged the old one. However in 2018 I had a breakdown and had to give up work. Hubby still works. We realised after the summer of 2018 we couldn’t justify the monthly credit payment for the caravan and spoke to the caravan park many times about what to do. Anyhoo we ended up surrendering the van and walked away. But they’re now chasing us for site fees of £1907.96.

We owed money on the van as well but Lloyd’s bank wrote it off because they realised we couldn’t afford it. park Dean day we owe this for sites fees but I’ve noticed they’ve charged us £30 everytime a direct debit failed for site fees when we had the van, so question 1 is can they do that?*

Also DWF have sent us a letter of claim saying we have to fill in an expenditure form or they’ll take us to court and usual threatening stuff.*

I don’t see how it’s a legal debt because we no longer have the van.*

Do I fill this form in or not?*

Hope that makes sense I’m still not well now and have never returned to work

    thank you
