  • Amendment to Order in court judgement

    I recently took a sole trader to small claims court. At the hearing the judge made an order to amend the claim from the individual (trading as a ltd company name) to be against the limited company name. This was done as the contract was titled under the limited company name. Having won the claim it has now become apparent that the limited company does not exist, and never has. The individual was operating as a sole trader. I am therefore unsure of how to proceed in enforcing the judgement. I assume I am unable to enforce against a limited company that doesn’t exist as the individual would be under no obligation to adhere. I am fearful that I am going to have to go back to court and start the whole process again. This would be at an additional cost to the amount I am already out of pocket and for an amendment that was made by the judge with no knowledge or confirmation of the consequences/accuracy of the order. Any advice on next steps that would enable me to enforce the claim at minimal to no additional cost would be appreciated.
