  • Charges against property

Am seeking a remortgage and found out there is an equity charge by free holders against property. There was a court case over 6 years ago where freeholders withdrew from case as they could not provide evidence required by Leasehold Tribunal. Are they allow to place a charge against property in such circumstances? Would appreciate advice on how to remove these charges with having to pay free holder.*
