EDF sold a debt to Lowell Financial Group in November 2017, I received a Claim Form on 7 October from Lowell Portfolio 1 Ltd via Northampton County Court.
It relates to an account with EDF opened in 27 April 2012, when a letting agency gave my details to EDF with my knowledge or consent, for supply to a flat.
When I challenged Lowell Solicitors for a deed of assignment from EDF to Lowell, they said “we do not have to give that to you legally”, surely that cannot be correct???? They also said that the assignment was made out to Lowell Financial, however the claim is from Lowell Portfolio 1, again my question is this a valid defence??
1. The claimant is different from the assignment of deed, i.e. Lowell Financial vs. Lowell Portfolio 1
2. They will not provide any proof that they are the valid owner of the debt by producing the deed of assignment from EDF to Lowell.
Hopefully somebody out there can help with this??
