    Hi all,

    I'm new to the forum and have just helped my partner VT with BMWFS , who then produced an excess mileage charge invoice for £1500 after VT was confirmed. We replied with a detailed letter based on information gleaned on this very helpful forum , that excess mileage charges are not applicable . They have sent a reply 'disagreeing' with our letter , quoting section 99 (2) of the Act which seems like a common trick finance companies use , i.e ' Section 99( 2) provides that termination of an agreement by a customer by way of VT does not affect any liability under the agreement which has accrued before termination'. They also quoted section 173 of the Act which I have not come across before , i.e. 'The Act does not preclude us from having our own Terms and Conditions' . The gist of their argument is that excess mileage charges are accrued 'pre termination' . They are also threatening to 'accurately report any amounts outstanding on the agreement for more than 28 days'.

    Any advice on what to do next would be gratefully received.
