Hi all, hoping we can get some help with this!
My partners car car broke down in May last year and was sold for scrap. He assumed the scrap age company informed the DVLA that they were in possession of the car and therefore, he didn’t have to cancel his insurance. He then received a fine, which he paid.
After paying the fine, he called the DVLA who told him he either had to inform them online he was no longer the registered owner or send them a letter. The scrapage company was not recognised by the DVLA web page, so he wrote a letter. This was around 6 months ago. As we didn’t hear anything else, we assumed the matter had been sorted.
Apparently they never received the letter and now he’s received a court summons. He has proof of the phone call with the DVLA, a receipt from the scrap company and has since sent another letter to the DVLA which he has proof of postage for. He doesn’t have proof of the original letter.
We would like to know if there is a way of getting this case dropped, if he is better pleading guilty or non guilty and what the penalty could potentially be.
