  • Escalated costs when a settlement figure had been agreed with the creditor

Hi I had cancelled my membership and paid my final DD at the gym and then cancelled my DD. The bank retracted the final payment of £11.99 which they admit was a bit remiss in the circumstances of having paid it for a year. To cut a long story short I got a demand for £60 from CRS Harland. I had no idea what had happened until I contacted the bank and the gym. The gym offered to let me settle by paying £11.99 and £25 admin fee which I accepted. Paying it was a different matter and although I tried to pay it 3 times I was given the run around by both organisation for 6 months. The escalated costs stand at £177, despite me contacting CRS 3 times and explaining everything and despite the fact they said they would email the gym to find out what we had agreed.

I have complained but was told that Harlands complaints department do not deal with CRS complaints, even though the Customer Service Lead had advise me to complain to Harland's complaints department. So I sent the complaint to Harlands CRS. Finally I contacted the Managing Director of the gym because I felt the gym had caused the escalation of costs by repeatedly telling me I could settle at the fee agreed and said they had fully documented this in the notes. Despite telling CRS by letter in August the costs have escalated further. The Managing Director has said he will instruct CRS to stop chasing me for the debt but he has not accepted my settlement fee or admitted that the costs have been unfairly escalated.

I have been threatened with court action and I said I was prepared to go to court because I believe this is unfair. They have retracted that threat and are now threatening me with a debt collection agency even though I have complained and they have not replied and even though this is a disputed debt.

    Any advice would be welcome.

    thanks
