  • Appeal Permission from biased Possession order from District Judge

    Local authority brought a claim of possession against me after 2 years of investigation to speculation of subletting. I attended the Court as litigant and was confident to win as I had provided a large volume of evidence that I have continuedly lived in my property as secure tenant for last 22 years. my evidence was such as digitally dated photos, Facebook Photos, over than 8 neighbours written statements...However, to my surprise, the judge gave little direction at the hearing and left the LA barrister to misinterpreted the law and facts as he wanted. She then ordered a possession order against me and took the same line as LA. gave no weight to my evidence and claimed LA were consistent in their claim. I was shocked and did not know what to do. Only after 2 weeks, I decided to complete the appeal papers. the Circuit judge directed me provide the transcript of Judgement and to attend an oral hearing for permission in Nov. I am still waiting for transcript as an ongoing issue of tapes did not capture judgement, has not been resolved for 2 months now. I submitted my ground of the appeal on basis the order is not consistent with Rent Act 1977 and Housing Act 1985. Secure tenant are allowed to take in lodgers but LA represented the case as it I parted with possession. the D Judge discarded my evidence as not credible. How the Circuit Judge operate as I am worried if C Judge take same position and refuse to give me the opportunity. Can I appeal to supreme Court or Appeal Court as 3 judges are safer than one judge. Any views please, I have no access to legal aid and no access to my funds.
