I received a 2 year restraining order on my property and partner. This was given for kicking my back door (knocking the cover off the cat flap) and swearing at my partner because she would not let me in. Earlier that evening she had left me in a restaurant for taking offence to what I had said. I finally got in through an open window by which time she had voice recorded me. When inside I told her to go to another room and get out of my sight. She had also called the police. I was arrested for breaking a window (untrue). And being violent towards police (also untrue). I was locked in a cell for 12 hours before being released with a charge of using violence to secure entry. When interviewed I was asked what had happened and my story concurred with my partners version of events. She had also made a statement and given the police the recording. When in custody, I was verbally abused by a pcso, and also shoved in the back by the same pcso whilst walking into the cell.
Im 49 years old, and this was my first offence.
I pleaded guilty to the offence of using violence to secure entry, because I looked online and I did actually commit that offence.
I also received an 18 month conditional discharge.
I think the punishment far outways the crime? Totally unjust.
I run my business from my home, and also worked hard for 10 years to be able to buy the property 1 year ago. This is when I moved in with my partner. This happened 2 months ago and the effect of the order has totally destroyed me.
