I'm new here and have been done most avenues, FOS, FSA, BVRLA, CAB, Trading Standards, Motor Codes etc...
I have a Vehicle on Finance Lease through my Limited company via RCI Finance. The vehcile was supplied new end of Apr 2011. From day 1 the it had defects. The manufacturer, Dealer & RCI where notified within 7 days of collecting the vehicle of the defects. Staring issues, locking issues, door rattle, poor paint finish, air bag light remains on...
It has spent 4 months off the road with a dealer under the instructions of the Manufacturer. The manufacturer will not replace the vehicle. They want to continue attempting to repair the faults. The major one being it's failure to start. I've stated I want a replacement as the vehicle is not fit for purpose.
I've had 14 courtesy vehicles to date whilst my vehcile is in for repair. They have failed to repair any of the issues. They are currently at a loss as to what is causing the starting issue themselves and have stated other vehciles have issue... Surely it should be recalled. The ECM, injectors and fuel pump has been replace under warranty. Still they are unable to resolve the issue. It is currently off the road with the dealer at the moment.
I find it hard to believe a manufacturer is still unable after 12 months to fulfil its obligations to repair the vehicle under the Warranty Agreement. They've had numeous attempts to fix the issues and failed. They keep stating there obligations to repair, but cannot give me a timescale for repair, nor they advise do they have to. They also state that the issues I'm experience do not warrant a replacement...
RCI Finance will not request a replacement vehicle. RCI referred my to the FOS. The FOS cannot help as it's finance through a Limited company and the Consumer Credit Act does not cover Limited companies. I've stated to RCI I want a replacement as the vehicle is not fit for purpose. They cannot act with the manufacturer approving.
I'm stuck in a vicious circle here. My vehcile is my office. My business has been severly affected. My health is being severly affected.
I'm a small Limited company and do not have the finances to involve a solicator.
Where do I stand legally?
ANY advice would be gratefully appreciated.
