  • PCN in Camden

    Hi,
    I received a PCN in Camden on 25/07/16. I appealed via their online system that shows the evidence the warden took, which was stated that I was in a parking bay for residential parking although the photos clearly don't show any parking bays or lines at all. I didn't hear anything from them or receive a letter so I called them on 25/08/16 (a month later) chasing it up, where I was told there was a backlog due to summer holidays etc. After another month on the 28/09/16 I called again and was told that the officer dealing with my case was sending out a letter "today". After not receiving a single letter from them I tried to call again on the 12/10/16 where I couldn't get through this time.

    I received a letter today for a "notice to owner" stating I owe £130 and would increase to £195 if I don't pay within 28 days. It was supposed to have been frozen until the appeal was heard although I never received a response. The photos on the notice received today are not clear, a photo of the sign was taken that not readable and the photos of my vehicle don't show a number plate (see photo).

    The questions I have are;
    • Has the procedure to issue a response from the council taken too long and invalidated their PCN?
    • As I've appealed to the process and is in their records, how can I escalate this further as I haven't received a response but have been issued with a notice to owner?
    • As they have taken over 3 months to reply, am I able to take them to a tribunal or court over undue stress/destress etc?
