I’m in a difficult situation and would really appreciate some legal insight.
I entered into a business hire agreement with a vehicle provider who advertised the package as including “comprehensive insurance”. However, following a recent non-fault accident, I discovered they only hold a third-party only (TPO) fleet policy. They now claim that although technically TPO, I “enjoy comprehensive-like cover” because they internally fund at-fault damage and charge me a £1,000 “excess.”
Except for the insurance certificate which does not state the level of cover they’ve refused to provide a copy (even redacted) of the actual fleet insurance policy, despite my contractual obligation to pay for it weekly and references to its terms in the Hire Agreement. The Vehicle Driver Handbook refers to it as “comprehensive,” and their website promotes it the same way.
They’ve also instructed a claims management company to act in my name without my explicit consent, I had only provided initial accident detailsz
I would really appreciate some legal insight as to what, if any, options I have.
