Hi all hoping somebody could help with a charge I have received. The contravention is a "52M failing to comply with a prohibition on certain types of vehicle" which allegedly took place at 8:32 on the 19th December 2024. Date of PCN and posting is 10/1/25 and date of service of PCN is 14/1/25. The reason for the delay in me receiving the PCN would be because I have a company car on lease so this would have gone to the lease company first.

The signs on google maps are outdated and the restricted time is from 8:30 (I have been back to check) at the time stated on the PCN I would have visited the shop that is shown in the street view. Upon leaving I completely failed to notice the sign stating the restrictions and I am assuming this has happened before as there is now a new sign on High Street informing drivers of the restrictions if turning right into Church Street that isn't shown on Google Maps however this is the other side of the butchers so was not visible to me as I pulled out of the car park. I drove up Church Street to access the shops and just assumed I could go back the other way. I know not noticing isn't an excuse in itself but in my opinion the signs are poorly positioned. To turn into the restricted area you are looking for oncoming traffic and this makes the sign easy to miss due to its height (as I said I have been back and tried to replicate.) Also the new sign which I have mentioned above is on the opposite side of the road to the shops but positioned roughly between house number 61 and 63 I would never have seen this sign as I turned left into High Street from Church Street and is facing the wrong way for me pulling off the car park. If the sign was further forwards eg in the area where the yellow parking restriction sign is outside 65 this would visible to shop users.
Do I have any grounds to argue at all based on the sign layout? Failing that could I say I was delivering to the school and hope I wasn't asked to provide proof? I have found some council documentation relating to this street which says "The restriction applies only to vehicles entering during the prohibited time you can leave at any time" I know it is clutching at straws but being parked at the shop in the picture I was behind the sign advising of the restrictions if turning right but also behind the sign that actually states the restrictions. If I had of parked in one of the bays marked VC I would have been inside the restricted area and free to drive through it to leave if I had reversed but not if I had drove forward onto High Street which seems to make no sense
