SEPTIC TANK ISSUE
Our deeds state the following:
Our neighbour has the right to having a 'Septic Tank' on our land - Location to be agreed between the owners of both properties. They have to maintain, repair and renew their septic tank, pipework and soakaway and make the area good causing as little damage as possible to our land at their own cost.
There has always 2 SEPTIC TANKS one for our neighbour and one for our property right up to 2009.
In 2009 both property owners prior to our purchase decided to have one Septic Tank installed and share it instead of following the deeds and having two separate utilities. They split the cost and completed the work and now there is only one shared septic tank on my land.
We had new owners move in 6 years ago to the property which has the right to have the septic tank on our land. They have started to become awkward with the arrangements.
Firstly they are relying on us to check the Septic Tank and made no effort to check it themselves. They simply send a check to cover half the emptying. Their effluent pipe hasn't been checked in over 9 years either. We understand septic tanks don't require much maintenance but they are just leaving it all to us. We have also received an email which implies we are supplying them with a drainage service and if it should go wrong then we would need to provide them with some sort of alternative due to the inconvenience it would cause to them. This seems to be getting out of hand.
My question is do we own the septic tank and allow them to connect to it? Neither ourselves or the current neighbours paid for the renewal it was all paid for by both previous owners of each property.
How do we get them to check their effluent pipework it measured 40 metres long so understandably we would like it checked every few years for debris and condition.
