  • Outstanding mortgage

Can someone please explain how it is possible for the owner of land/property that he has mortgaged to Yorks Bank to alter, extend then sell the existing property whilst the Bank's all monies charge is still outstanding? I don't know but I suspect that the Bank failed to register its charge with Land Registry and that land/property was unregistered until the sale of the extended altered dwelling triggered 1st registration.
