  • Conveyancing Issue - Section 104 Agreement

    I have recently purchased a new build property on a small development which includes a sewage pumping station. The developer has failed to complete the estate road along with the sewage pumping station and looks like he is about to go bankrupt. We are therefore left with a half built sewage pumping station which is unfit for purpose. The developer failed to have in place a Section 104 Mandatory Agreement with the local water authority prior to commencing the build of the pumping station in order for the station to be adopted in the future. At no point during the house sale did my conveyancer bring to my attention the fact that a Section 104 Agreement was not in place and I am therefore left in a situation whereby my house in currently unsellable. Had my conveyancer alerted me to this fact I wouldnt have bought the property.
    Do I have grounds to report / complain against my conveyancer and they had neglected to highlight this important issue to me?
