  • Can anyone help with defending possession proceedings?

    I am defending possession proceedings under a Section 21 notice.

    I had withheld rent and went to move out ('effective eviction'/harassment) after my complaint regarding:-

    - repair issues (involving essential services, for many months, through failure to prepare property correctly for tenancy, and failure of workmen to establish the problem/correct it quickly enough) and
    - written and audio-recorded
    reputational attacks on me, by letting agent (antisocial, bullying, abusive) and landlord ('running a business' - for which I had audio-recorded permission - etc)

    went ignored for 18 months. It has been presented to date around five times in writing, and not once acknowledged, let alone replied to. Meanwhile, landlord decided to refuse to repair on grounds that I might be causing malicious damage (after several excellent property inspections during my tenancy, and my carefully overseeing many repairs and improvements).

    [I have informed the council, who say they will inspect, and in that, I'm looking at the Protection from Eviction Act. Causing another to give up property. S3.
    Shelter are arranging for me to speak to the press next week if all goes well. This is partly to put the matter on public record, so the council are less likely to refuse help, and partly to attempt to get the unfair laws governing private tenancies overturned].

    1. Is anyone who sees this experienced in defending S21 proceedings, and if so, can I use abuse of the legal system itself?
    2. Can anyone make a qualified comment on adjournment of possession proceedings? Can I request adjournment? (I have no experience of this, despite winning a possession proceedings in 2006). On what grounds can I request any such adjournment?

    (Sorry, but I haven't much time for chat, my utilities are in arrears and I am threatened with street homelessness in a matter of weeks).
