I am selling a house with an attached annex, it is really the house next door but was renovated several years ago into what planning department described as an 'annex' with bedrooms, a bathroom and kitchen /diner and lounge, it does though have a planning restriction to be used only as part of the main property.
So its been empty for a while but we have started using it having people to stay etc, so some nice neighbour has told the council who have decided to write to say it needs its own council tax as its obviously a second property but doesn't have its own council tax band. We are disagreeing with this but we will see.
So this has sparked our interest, we looked back through the documents and building control says it is an 'extension'.
We have asked the valuation office to look closely at the planning restriction saying it can't be used as a stand alone property, but now realise that the building regs describe it as an extension, which seems odd. Its definitely not an extension it is none of these things really, its a house in its own right that has been passed as an annex through planning.
Can anyone make any suggestions?
