    Hi there,

    I am in a bit of trouble in my rented flat and could be evicted on Tuesday! It's quite a long back story:
    I moved into my flat in January, found it through Spareroom with an agent. After around 6 months of living there I received a letter from the courts and a lawyer with a section 21 eviction notice - this was addressed to my agent and 'all other occupiers'. After contacting the lawyer, it turned out that my agent was actually a tenant who was subletting the property without permission, and he wasn't paying the landlord any rent - he racked up £21k in owed rent. Very annoying considering that myself and my flatmates were all paying our rent on time and this fake agent was keeping it all for himself.

    I got in contact with the landlord, who to make matters more complex, uses a agent - the real, genuine agent. This real agent came over to the flat and told us to stop paying rent to the fake agent as he wasn't paying the landlord. He said that he could not setup a tenancy agreement with us until the court case had gone through and they had possession back of the property. So from then (June) until now we have not been paying rent to anyone (pretty sweet).

    Now the court date is set for next Tuesday and we have just been told that a bailiff may be appointed to vacate to property and that we should prepare for the worst, that we could have to leave the property for a number of weeks, along with all our belongings - mentioning that they may want to renovate the property, increase rent and who knows what else. He said he can't setup a new tenancy agreement before we leave because they're unsure of when we'll be able to move back in. It also seems like the real agent and landlord don't want the courts to know that we are in the property, someone came over a few weeks ago to do a inventory check and we were told not to tell him our names. So the courts think it's a simple case of a tenant who hasn't paid rent in months, when the reality is more complicated.

    My flatmates and I don't want to leave the property without having a new tenancy agreement in place so they can't increase the rent whilst we're out of the property and could be left in a position where we can't move back in and have no where to live. It leaves us in a situation where we're now scrambling to find a new place to live as there could be a bailiff kicking us out 2 weeks after the court date on Tuesday.

    If you've read all that and it makes sense you deserve a medal. Any advice would be greatly appreciated.
