Good Morning Everyone ! This is my first post so please bear with me. I hope someone will help me. I live in a maisonette so I have a flat above me. I’m the owner of the house but not the land as I’m the leaseholder. I had a leak in January 2019 from the above flat as the owners were away I couldn’t approach them straight away. When they came from holiday we approached them and after couple of weeks the above flat owner came inside my house to check at the leak. He said it’s not my leak where I told him it’s your leak cos my ceiling and walls are wet. After couple weeks again I approached him and I asked him did u fix the leak he goes to what leak. So I threatened him that I will take him to court. He said take me to court. In the mean time I have health issues too so I didn’t get time as I have been running to the hospitals for different scans. I reported them to the freeholders and one of the manager got in contact with them and the flat owners above us said to him that they have fixed the leak.
Now last month the leak got worse so we approached the neighbour again and told them the leak is not fixed. My wife turned the recorder on while talking to the owner where he clearly admits yes they fixed the leak couple of times. Since than they have been messaging us on our phone giving us different excuses. That leak is not our, it’s your leak, it’s from main pipe. We have to give them half the money to fix their toilet etc etc. Now they have refurb their toilet bathroom and have fixed all their pipes I guess as I can see all toilet stuff is in the front of their door. My insurance ran out over a year ago and I didn’t realise it as I was going through mental stress cos of mom ill health.
Can someone please help me as this neighbours are so cunning and they want us to suffer. I have two young kids and they to breath the damp for nearly a year. I have been using a dehumidifier to dry my walls and ceiling. By the way the leak from their toilet has damaged our ceiling and wall in bedroom/bathroom toilet too.
