Had advice before regarding this matter but could do with a little help. Limited company set up in feb 2016. 2 directors 1 minority shareholder and one majority shareholder. company register for VAT. in april when customers had paid and money was in limited bank account clearlng, the majority shareholder closed the account. went to the customers, told them not to pay the vat and pay him in to his personal account. he has confirmed he has had the money, never paid any creditors and run off.
I reported the matter to the police. no help. I reported the matter to HMRC Vat fraud department twice no response. I reported the matter to insolvency service no response. The inland revenue now tell me I'm responsible to pay the VAT due. ive explained the VAT has not been received nor has any money at all.
I could try to recover VAT from customers but even if I did I could not bank it as I'm unable to open an account in the company name as the other director has refused to allow this.
We did consider the company sueing the majority director but this was not a simple claim and would be very expensive. so not an option. any idears what I can do to rectify the situation.
