I am the Claimant in the process of small claims action, and want to make an offer to settle before the case is allocated to a track. What is the best way to proceed with this. At this stage the case has not yet been allocated to a specific track. The case is with regards to breach of contract/negligance, so I would assume it would be allocated to the small claims track, as I have requested, but at this stage it has not been decided. Would a part 36 offer be appropriate at this stage?
