We are disputing the method of calculation of service charge on our property and witholding payment. The property Transfer Document has a clause which states that 'disputes with regard to the construction or effect of the Transfer shall be determined by arbitration'. We have taken legal advice in the matter and been warned that it is possible we could lose our right to arbitration if a claim was issued against us. Can anyone tell me what we need to do if we receive a claim in resepect of the unpaid service charge to be able to have this matter determined by arbitration rather than going to Court. Thanks.
