  • Failure to file witness statement

Hi I wonder if anyone can help please.
    my boyfriend is the claimant.
The claimant and defendant received a notice from the court to file witness statements on each other and the court by 18th October at 4pm. The claimant sent them to court and defendant within the time scale (all recorded delivery and signed for by both).
The defendant has failed to submit the witness statement to the claimant and the court within the time scale, he received a ‘letter’ with evidence on it from the defendant dated 23rd October (not a witness statement).
i rang the court on Wednesday and all post was up to date and defendant had not filed paperwork.
This is the second time she has failed to submit paperwork on time, can you let me know what usually happens in this case, what is the judge’s decision based on next?
    Thanks in advance
