I am almost 3 years into a child arrangements order at the family court and had numerous DRH hearings because the mother does not comply with court orders. I have asked the Judge to attach a Penal Notice on three separate hearings and he refuses. On the latest hearing he told me to apply for a Penal Notice if I wanted one? I am slightly confused because I was sat in front of the judge presiding over the case who has all the information regarding the non-compliance but yet he tells me to apply for one? My question being is there a separate form to request a Penal Notice be attached to court orders or is there separate hearing required?
