  • Wife's solicitor not responding and divorce stuck in limbo.

    I am the respondent in the Divorce from my wife, on the grounds of 2 years separation, with consent, and the petition was filed with the court in October 2018.

    The Decree Nisi was granted on 25th April 2019, and we both exchanged Form E disclosures shortly afterwards. My wife has responded with her terms for financial settlement, and having read her terms - I have responded to that with mine.

    Three years have passed since I offered the 50-50 split on our FMH, and to keep our own private pensions. We have no children together, and no other assets other than our FMH.

    Despite repeated emails to her solicitor over the 3 years since the Nisi, we are no further forward, and all email responses are limited to “We will seek our Client’s instructions and revert to you”.

    I must admit to burying my head in the sand til now, but really do want this matter resolved and the FMH sold.

    How do I proceed going forward?

    My new partner has suggested looking at the new divorce rules that have been announced recently, and wondered whether filing my own new petition is an option?

    I hope you can provide some advice!
