Can someone please confirm my Question please. My employment contract states that I am the store cleaner (1 of 2)
my contract hours are 28.50 working over 5 days I signed this contract about 12 months ago. since i have signed this contract I have only done at the most 6 hours per week cleaning covering for the other person on day off and when on holiday which so far has been 3 weeks. all other hours including overtime have been worked on other departments covering sickness, days off and holidays, when i help out on these departments they are usually charged for my help.
In September this year our company outsourced the cleaning side of its operation and all cleaners contracts are being transferred to the new contractors. we have now been told that there are no positions available to stay with the company although this was an option when the cleaning contractors were first trialled some 3 months ago, redundancy is not an option and if we don't go with the new company it will be assumed that we have resigned, our contracts have been TUPE'd which i understand, Yesterday I was told that if i have worked more than 50% of my contract hours off my department and on others i can challenge this with my company is this correct please. any guidance or advice would be very much appreciated.
