  • Deduction of wages - about to issue proceedings

    Hi All,
A friend is owed money (£450) by an ex-employer who claims to have made a lawful deduction to his final pay. He says this deduction is for overpayments made over a 6 month period of £75 Gross a month, hence the £450. He did have a pay increase from his employer 6 months ago (not in writing) and this increase continued for 6 months. During this period, at some point his employer did acknowledge an overpayment of £6 (which he subsequently deducted), so he was completely aware of how much the company was paying my friend. We’ve gone through the ACAS process & have certificate. We’re now about to complete small claims form, but I thought I’d ask you lovely informative people if anyone thinks his employer has a valid defence of his deduction of wages?

    Many thanks,
    Lba.
