  • Lease car contract signed - but no car available

    Good evening

    Hoping for some guidance please.*

    at the start of January 2020 I went ahead with a very good value lease deal on a new car via a reputable online broker. *I accepted the quote, I passed the financial checks, signed the online contract and paid the processing fee. *I chose the colour and agreed a delivery date for some time early March. *

    Today I contact said broker to agree an actual delivery date. Broker calls me a few hours later to say that there had been an error and there is no longer a car available for me. After some poking it turns out they did not get the paperwork off to the manufacture, It had been forgotten and I will not be able to get the car originally agreed at the agreed price.*

    The contact price was a very limited offer and a very good price. If I try to get the same car today it would cost me approx £6k more over the term of the lease.*

    Broker terms and conditions do not cover this situation and the broker refuse to budge on accepting they are in breach on contract. They are offering to find an alternative lease deal but they will not be able to provide a car of the same standard at the same price. *However terms do say that if I was to be in breach of contact or cancel at this stage I would be required to pay 3% of the BIK value.*


    Had I not have contacted them today chances are I would not have been told about this until March arrived.

    During the time I signed the contact and today I have rejected the same car at the same price offered by an alternative broker, but I declined this as I had already agreed to a lease. *

    So I guess all I’m asking is,
    is this acceptable?
    do I have any rights?
    Should the broker be delivery their end of the deal? *
    Is this a case of “loss of bargain”
