  • How to get clear information on Design Rights Violation in eBay Store

    Hi,

    I am running a small business on eBay and some days ago I received an email from eBay telling me that one of the product I listed on eBay was removed because of "Design Rights Violation - Unauthorised Item". They also gave me a company name and their email address who claimed that they have the design rights of this item and asked me to contact with the claimant to resolve it to relist the item on eBay.

    The item I am selling is purely a Compatible part of a device and does not have any branding information on it to relate it to any other brand/company.

    I tried to contact the claimant using the email provided by eBay but getting no response. I then wrote an email to eBay team asking for specific information to explain the reason for which design rights I am violating and they are also not telling me anything. I searched the IPO website against that company and there are a number of Designs and Trade Marks are registered on their name but nothing related to my product/item.

    I believe that it's my legal right to know the exact number/name of the design/trademark/patent that I am being accused of violating but neither eBay nor the company is telling me. I am not sure how to get this information and what are my legal rights?
