Met Parking ticket at gym

Hi ,

I have received second letter from Met threatening us to pay £100 in 14 days. They did not respond to any of my request that I sent in the letter (found on this form).

We were not able to respond in the 14day time period as we were on holidays so we were not able to appeal on give time period.

I would like to know what should be my second response? We parked the car in my Tooting leisure centre gym where there was a time written when not to park ( between 8:30am to 4:30pm). I parked that around 7pm. There was no sign of not parking on the yellow lines.

Can you please advice further.

Contact the gym managemnt and ask them to cancel.

You appealed and it was rejected ? You should get 28 days to go to popla, did you get a code ? If you did check it http://www.parkingcowboys.co.uk/popla-code-checker/

Dear Sir / Madam,
I am NOT going to pay you any money, unless and until you can fulfill the following conditions.

1. Validation of the alleged debt (the actual accounting), not a Photostat copy.
2. Verification of your claim against me (a sworn affidavit or a hand signed invoice in accordance with The Bills of Exchange Act (1882));
3. A copy of any alleged contract signed by both parties and therefore binding both parties.
4. Evidence and absolute proof that the car-park was being used by me, other than in accordance with your, or McDonald's, terms and conditions.
5. Absolute proof by way of verified and signed accounts, not Photostat copies, of any actual loss to McDonald's.
6. A signed copy of any contract you have with McDonald's, showing authorisation from them for the exorbitant charges you are demanding.

Under common law, and in accordance with unfair consumer contract regulations, the cost of any penalty claimed, must reflect the damages and loss suffered by the company issuing it.
England is a common law jurisdiction, and in accordance with Common Law, I do not have to prove anything.
I hereby give you ten (10) days to reply to this notice from the above date with a notice sent using recorded post and signed under full commercial liability and penalties of perjury, assuring and promising me that all of the replies and details given to the above requests are true and without deception, fraud or mischief. Your said failure to provide the aforementioned documentation within ten (10) days, from the above date, to validate the debt, will constitute your agreement to the following terms:


1. That the debt did not exist in the first place;
OR
2. It has already been paid in full;

AND
3. That any damages suffered, you will be held culpable;
4. That you will not appoint an agent to act on its/your behalf in this matter and that any negative remarks made to any debt enforcement company or credit reference agency will be removed, and will be subject to £5000.00 in damages.
5. You will no longer pursue this matter any further.
6. You agree to pay all fee schedules.

I wish to deal with this matter in writing and I do not give your organization permission to contact me by any other means. Once you have sent this by recorded, signed for post. You probably will not get a response.
Or Met Parking may very well try to fob you off with another demand.
If they do, let me know.

They replied back to me:


"As advised on the charge notice an appeal can be made in writing within 28 days from the date of the contravention as your correspondence was received ,the time for lodging an appeal has expired and charge notice is outstanding and payable.


While we have not fully investigated your appeal we can confirm that had you appealed within the time limit, it is likely that your appeal would have been unsuccessful as you parked on clearly marked hatched area.


Please settle the outstanding amount of £100 within 14 days of the date of this letter. If the charge remains unsettled we will seek to recover the monies owed to us via our debt recovery procedure and may proceed with court action. "


I parked my car at 7pm after reading the notice that said not to park between 8:30 am to 4:30pm. The notice is very confusing. As I was made to assume it's ok to park there after 4:30 pm."


What should I respond to this letter? They haven't responded to any of my query in my first letter neither sent any proof of contracts between my gym and MET.

To be honest, i have no idea where you are going with this horse shit. I suggest, now that you screwed up the best, and easiest, way to win that you try the gym management. Failing that try the person who suggested that ******** and see how helpful they are now.

Have you contacted the gym management as i've suggested twice before ? What have they said ?

Other than that, they will give you no chance to appeal so it's either pay or wait and see if they take you to court, which is far from a certainty.
