  • Application for CCJ hearing

    Hi there. I have just had a Notice of Hearing in the post this morning where I am due to have a hearing for my application to set aside judgement (CCJ) on the 22nd November.

    A little bit of background... I made this application because of that fact the claimant issued a claim against me back in 2016 whilst I was not living at the address they served papers at, so in turn I did not find out about this CCJ until this year after checking my credit file.

    The matter is brought about by Lowell Portfolio I Ltd.

    I did a draft defence and draft order within my application.

    I have recently requested and had confirmation back from Lowell (their solicitors) that they have requested a copy of the CCA from the original creditor (that being JD Williams) which forms part of my defence because I want them to provide proof of this debt.

    I am just after a little advice on what to expect at the hearing or what is expected of me by the Judge?

    When I did a Draft Order I did set a down a couple of deadlines being:

    1. The judgement in default dated 17th August 2017 be set aside
    2. The defendant shall file and serve its defence by 4pm on 25th October 2017

    Should have I complied with them or wait for the Judge to make them decisions (should he make an order to set the judgement aside!)
