  • What court should I file proceedings under The*Environmental Protection Act 1990 at?

    Hello,

    I'm intending to file proceedings under Section 82 of The Environmental Protection Act 1990 shortly against a large construction company.

    I'm unsure if it should file this at Hatfield Magistrates Court or Stevenage Magistrates Court.

    I will need to see the Justice of the Peace or Justices Clerk I believe to file my complaint. Are they present and accessible at all times during business hours at any Magistrates Court? This is the first time I've gone to Court so I'm unsure what the standard procedure is for this. Should I aim to arrive at the court just as it opens at the court at 9am?

    The reason I was thinking of filing at Stevenage Magistrates Court rather than Hatfield is that it seems more widely publicised, Hatfield Magistrates Court isn't displayed on Google Maps for some reason.

    Either really, which ever is most convenient. Their details can be found here: https://www.gov.uk/find-court-tribunal

    Give them a ring and I'm sure they'll be able to tell you the availability of the person you need to meet.

      Write to the Court to make an appointment.
      In your letter state your address and that you wish to start action under Section 82 of the Environmental Protection Act 1990.
      The Court will advise you of where and when to attend.
