Hi
We (as leaseholders) were served a light obstruction notice in May 2023 regarding a proposed development on neighbouring land.
We have since been informed by the developers surveyor that we are unable to challenge the notice (claim a right to light) as over a year has now passed and they have registered the obstruction as a local land charge with the Council. They have provided evidence of such.
Can you please confirm if this is correct and if so, is there potential to claim a right to light via any other legal route?
