  • Cca request advice payday loan debt unpaid

    Hi guys I'm a new member looking for advice regarding a court claim received from local sheriff Court for a payday loan debt which is being pursued by asset management debt agency.*

    I've did some searching here and seen steps to do cca request etc my question is that I submitted a Sars request to original payday lender and instantly received a folder by email of agreements, defaults etc in the agreement it sets out all interest and a putts to be paid and dates with my digital check box name signature at the end is this basically the cca?*

    My worry is I now submit a cca to the debt agency and they sent this agreement instantly is that me beat?*

      Hey Aquaman cool name..presumably with sars you admitted it was you and payday lenders would have limited sars due to limited info requested eg your declaration of income and then a credit check etc. Sounds about right .You have by asking for sars admitted your debt but not all lost .Is it statues barred last contact payment etc over six years old and some debt collection chancing their arm ? If not is one of the lenders gone bust peachy sunny uncle buck etc lodge unaffordable complaint regardless if a unaffordable applicable include DCA . Debt camel site has lots of good help regarding this and featured on this site before

        The default was registered 2018 so still in date. Its been sold to a debt collection company and its them who are perusing me in court for full debt. Original lender was lending stream. I did a sars to lending stream and not with the debt collector. There is actually a solicitor taking lending stream to court based on unlawful lending on my behalf in a group case will this need to play out separately or could I use waiting the outcome of that first as my initial defence?Â*

        Do you think I could have a chance of cca request to debt collector now and defend if they don't respond?

          I think DCA would just supply copy if at all of lendingstream sars Simply reply to them you are disputing and have legal case prob snival away or chance their arm but make it clear it's in dispute and not prepared to pay until legal decision mark as disputed on your credit file Experian noodle etc Good luck
