Received a CCJ

I am absolutely devastated. I received a CCJ attachment of earnings form to my new address in my former married name. A CCJ had been issued against me on 11th November. It was from Cabot Financial represented by Restons Solicitors. I did not know what debt was for and heard nothing till this point. Just contacted solicitors and advised it was for a Next account from 2006, I explained I am knew nothing and should I have been contacted I would have applied for Statue Barred as from so long ago. They said they had sent mail to my previous address but I did not see it or if I did would have returned it as not know at this address as not in my name. Feeling really stressed out and dont know what to do

Indeed, as Mike said you will need to make an application to set aside the judgment - first job is to get a copy of the claim from the court or Cabot/Reston's then ask Reston's for their client to consent to set aside. There will be a £100 application fee unless eligible for fee remission, and it's rare to get that cost back ( but worth it vs six years of a trashed credit rating )Â*

if they don't consent then it would be a £255 fee but more likely to have that awarded against Cabot.Â*

when you moved from that previous address did you update on the electoral role / credit file etc ? You want to show court there is no reason that Cabot couldn't find your new address and name easily.Â*
