    Hi all, just joined here but have been a fan for sometime and had so much advice ... brilliant site. I’m fighting two county court business centre cases at the moment ... so far so good .

      Thank you. I have had a letter saying I need to prepare paperwork/evidence for local court to fight my case against Lowell. They say my son owes money for an 02 account from last year. He gave his phone to a mate who then took over the account... he paid £78 for this as requested by 02. They then said my son owed over £300 ... which he never paid as he’d paid the £78. Now Lowell are trying to recover this money. Do Lowell actually turn up to court? We will e taking this all the way ... we have had no proof we owe this money even though we have asked for evi*♀️*♀️dence.

        Yes, they do turn up and yes it will go all the way, unless you can prove that it's not owed.

          The claim is waiting to go to local court and I am now preparing my case to send to Lowell and the court. I haven’t started it yet I need to get my head around it lol. It’s got to be done by 19th June.
          I have followed the court procedure on moneyclaim ... I have also asked for proof of the debt but received nothing from Lowell.

            Your response is confusing...

            Have you filed a defence or just acknowledged service?

            What proof and how have you asked for it?

              I’m so sorry I’m not very good at this am I?! . So I have filed a defence and now I have been sent a date for local court (I still haven’t written to Lowell and court yet with defence for court). The date is in August and Lowell have to pay £55 to court by 17th July to pursue... if they don’t it will be cancelled and end of.
              The proof I have asked for is of the debt from O2 ... evidence we owe this money and for what.
              I still have had no reply from them ... I sent email to them on 26/3/19 and 26/5/19.

              I guess i should get the defence written up and sent to the court and Lowell. Would my best line of defence be the fact that they have not produced any proof of this alleged debt?

                Again this is not a clear answer, you say you have filed a defence in the first sentence and then talk about the need to write up a defence to send to the court, do you mean a Witness Statement to send to the court?

                What did you put in your defence?

                    I WON! The case is now closed Lowell folded after I had sent my witness statement to court and themselves! This is all thanks to posts I’ve read on here... thank you all ... great site. Lowell and such companies are just bullies! I also won my case against Civil Enforcement ltd just before going to court they too folded!!
