  • County Court Claim

    Hi good people, looking for some advice on how to defend a county court claim for a parking ticket, I ignored all previous claims until I received this. I have been on line and acknowledged the claim just need to know how best to defend it.

    Here is the County Court Claim and the parking sign, can anyone help with defending this please

      Hi & welcome

      Well done with the acknowledgement!

      Is that the only site sign?

      Was there a windscreen ticket (Notice to Driver), or only a postal Notice to Keeper?

      & if you have either/both, could you redact personal info (leave times/dates visible) & post up pics of front & rear?

        Hi, there wasn't a windscreen ticket and unfortunately I haven't kept any of the correspondence

            Ok.

            To do list

            Firstly, send one of these to PCM, requesting all your personal data.

            If you use land mail, always keep a copy & get proof of posting.

            Then email DVLA & ask whether any searches were made on your vehicle between [x date] & [Y date]....a couple of months either side of the actual 'contravention' date.

            SubjectAccess.Requests@dvla.gov.uk

            That should get you on track.......you can also send a CPR 31.14 request to the PPC (or their sols if applicable) for further info.
            We'll deal with that when you come back.

                          Scrub all reference to CCA (Consumer Credit Act) & adapt to suit your case.
                          CPR = Civil Procedure Rules.
                          A CPR 31.14 is used to get disclosure of evidence.

                            ok thanks for all your help so far have completed the CPR31.14 request will post tomorrow along with disclosure request to the CPM.
