The blog could be seen as paranoia and conspiracy, except it contains sections from communications written by Peninsula, which they have confirmed are genuine. Those sections show that Peninsula approved breaches to employment law, and then went on to mislead an Employment Tribunal.
We've done nothing with the information because the Claimant in question had lost all faith in the legal system, not because of Peninsula, but because the judge at his tribunal was so willing to believe everything Peninsula said even when there was documented evidence to the contrary (the judge twisted such evidence to favour respondent. but that is another story).
To do anything with the information we now have would cost money, something the Claimant doesnt have much of. Hopefully he will soon be in a position to put his case before a court to have the decision set aside on the grounds it was obtained by fraud - all the evidence of fraud is now available, it just needs to get in front of a judge.

Off topic but we find it strange that WhiteVanMan was so interested in what we have been saying that he went over to the blog and read it all - which in itself is a feat, then came back here and signed up, then asked us a couple questions about it - the one about site views had nothing to do with the actual case, then he vanished without another word! Thats the kind of thing people do when they are digging for specific information but dont want anyone to know who they really are!!!
Wonder if it was actually someone working for........you know who?!

Thanks. Once in court, getting the judgment set aside will be the easy part; getting the issue before a court will be more of a challenge though.
Will look into it some more before suggesting this course of action to claimant.

I don't know about the consequences for any fraud but when a judgment is set aside it goes back to the point that the claim was first issued.

The Supreme Court recently stated that a judgment could be set aside on the grounds it was obtained by fraud (it wasn't in relation to an ET, but a judgment obtained by fraud is still a judgment obtained by fraud whichever Court it was in). If you manage to get a judgment set aside on those grounds, what happens next? Does the case get a new hearing? Are there any consequences for the side that committed the fraud?
We have all the evidence needed to show a judgment was obtained by fraud, but pointless starting anything if it's going to end nowhere.

Anything they could say face to face, they could just as easily say on the blog - except the blog would be a documented record. With what we know of them now, they wouldnt want any conversation about this documented, and anything they say verbally can be denied or twisted by them.
Originally posted by WhiteVanManIf you have all the evidence why write a blog about it, why not go to the tribunal board or escalate your complaint/case higher to expose their deception?

Meanwhile if you read the MEN they’re showing off that they’ve just made £260 million in the past 12 months!
Their former Head of Employment Services is on record saying:
The strength of the field operation lay in the face to face contact between the consultants and our clients. I introduced a system that would also take advantage of this contact to generate new sales. By January 2006 the income from new business generated by this department was greater than the costs associated with it.
Because of this involvement I was asked to develop an online service to attract new clients and make it harder for existing clients to cancel their contracts with Peninsula.

They recently contacted the blog for a 'discussion' with us, but now they wont say a word!
To be fair, there is nothing they can say to justify their actions, but it would have been interesting to see what excuses they came up with!!

They made a threat to start legal proceedings almost 12 months ago but never followed it up with any action!!!
