I won't go into the long history of a dispute with beneficiary no.3 of will who says a loan was actually a gift. However, they refuse to negotiate or attend mediation. When the loan/gift was first discovered beneficiary no.3 said verbally to beneficiary no.2 that as they had been gifted the bulk of the estate funds they were willing to let the two remaining beneficiaries divide the estate residue between them. This was conveyed to me in an email by beneficiary no.2 but not confirmed in writing by beneficiary no.1. Beneficiary no.2 agrees this was discussed and agreed verbally with beneficiary no.3. However, beneficiary no.3 now says that due to the bad feeling over the purported git they withdraw their offer. What happens now? Do we have any legal recourse?

Are you the executor?
Are you a beneficiary?
Has probate been granted?
In the deceased's papers is there any mention of this loan/gift?
What is the relationship between the Beneficiaries?
Have the courts advised mediation, or was this a private attempt to resolve the dispute?
