Please do consult a solicitor properly Has probate been granted yet? If not, you can submit a caveat which will prevent probate being granted before you can come to a settlement on this issue. It only costs about £3. You can do it online yourself. Apart from negotiations to vary the will to give effect to your Mums wishes ( wills can be varied within 2 years of death, and as sole beneficiary it is within your stepdads power to do so) you may have an entitlement to make a claim under the provision for family dependants act depending on your financial situation Those claims have to be submitted within 6 months of the date probate is granted so putting in a caveat can buy you extra time to explore that with the help of a lawyer.
