  • Executor standing down

Can an Executor stand down after Grant of Probate and intermedling?
Initially two Executors but one was excused due to ill health and later passed.
The Grant application was then undertaken by the remaining Executor who now wishes to stand down and appoint two new Executors. He has been advised that this can be done via a deed of retirement?

Does he question the advice he has been given? I consider it to be sound.
Lawyer (solicitor) - retired from practice, now supervising solicitor in a university law clinic. I do not advise by private message.

More a case that the beneficiaries seek validity of his claim. The Executor recently produced a PA15 form for this process only to point out that it clearly states within that this cannot be used if having intermeddled.
What is the procedure when using a deed of retirement please?

That is not the form to use for a deed of retirement. The PA15 is used by a person named as executor who wishes to renounce the right to act as executor - before Probate is applied for.

An online search will produce links to templates for a deed of retirement - https://www.google.com/search?q=deed...of+executor+uk
