  • Letter Before Action - Costs

    A few weeks ago I received a Letter Before Action, threatening court action as well as costs, ancillary relief and interests. In compliance with the Practice Direction on Pre-Action Conduct and Protocols under the Civil Procedure Rules, am I within my rights to request that the Claimant provide the total amounts of these costs to date?

    What is the sum being claimed? This may be relevant.

    But yes, you are entitled to request that information.

      Their intention is to seek a court order to declare the last Will as invalid and to probate the previous Will, so the sum being claimed would be their legal costs for the past few years of trying to achieve that. Would it be appropriate to also ask whether these costs have been paid by themselves or by their home insurance?
