  • No win no fee - pay off other sides solicitors?

    Not sure if this is something that is possible.

    Obviously if it's illegal I won't even consider it, however I'm pretty sure the claimant under the inheritance act against my fathers estate is on a no win no fee arrangement.

    I am inquiring as to whether it is possible to pay off her solicitors fees up to date and split the winning fee?

    I would also want it to be above board for both of us - we don't know each other but this could mean 10k extra each. I'm pretty sure she would agree but I wouldn't want to pay her solicitors and then she changes her mind. What would be the best way to go about it if this is possible? So we are both protected.

    If a solicitor is acting under a CFA he must notify the other parties.

    You can always ask.

      atticus thank you for your reply. I'm just doing some research before I confirm it. I don't want to do anything that might backfire.

      If they are under a CFA, what would the best way of going about trying to dodge it so we can keep the money in the estate? A way that will protect us both.

      I currently have until the 20th June to accept a part 36 offer. Which I will do unless we could save the fees (if they exist). I am thinking there is something we could do in the meantime to give her the money she wants directly, to resolve her claim legally, so I don't have her legal fees to pay out of my share (she would benefit greatly from this).

      If she hasn't agreed to this but the 20th June and I am not covered legally I will accept the part 36 offer, if I went over the 20th June I wouldn't feel I have anything to fall back in should she have a change of mind.

      I hope this makes sense.

        The best way of trying to "dodge" anything in litigation that has significant cost implications is to settle early.

        And don't try to be too clever. I can't se it working. This claimant will still have to resolve things with her solicitor and pay whatever is due to them.
