  • Nomination form for second administrator, application for probate

The sole inheritor of my partner's estate is our daughter who is under 18yrs. As she is a minor I have been told that I need to nominate a second administrator on a NOMINATION form to be sent in with my PA1A application. I do not know how to get hold of a nomination form. I have asked the Probate office but they have not replied. I would appreciate it if someone knows about this and could help.

If you haven't sent in the PA1A form yet you don't need another form. You name both applicants for Administrator on the PA1A.

PA1A has this note: "Where there are persons aged under 18 benefiting from the estate then two applicants (or at least two) will be needed in Section A. You may wish to contact HMCTS Probate to seek information in regard to who is eligible to apply."

So assuming you have someone who is eligible to be the second applicant you just include them in Section A. Sections 1.1 to 1.5 are for your details, 1.6 to 1.8 for the second applicant. Both applicants have to sign in Section 8.

You could contact (surviving) parents, brothers, sisters, nieces and nephews of your partner, to see if they would be prepared to act as joint administrator for his estate and joint trustee for your daughter until she is 18
