I am dealing with a Will which leaves multiple pecuniary legacies to various beneficiaries in priority to another. Clause 2 of the Will, which leaves pecuniary legacies to many family members and friends, ends with a direction 'that the legacies in this clause shall be paid in full in priority over any other gifts set out in any subsequent clauses in this my Will'.
Clause 3 of the Will then leaves a large pecuniary legacy to an organisation.
The question being, does the direction in the Will at clause 2 hold weight? We are not sure that the estate will have enough money to pay the clause 3 legacy in full.
