  • Beneficiaries entitlements to estate

    Hi,

I am named in a will as joint beneficiary to my Grandfathers estate with my sibling and mother. My mother is executor.

I have briefly viewed the Will and it initially says that the estate goes to my mother “absolute” (I don’t know if this is because she is executor) and then my sibling and I are named as having an equal share. There is no specific percentage share mentioned in the document at all.

Does anyone know what this means? Is it essentially left up to her to decide how it gets distributed?

My Mother has mentioned her keeping half and splitting the rest between my sibling and I equally.

This looks confused. Typically it might be a gift to your mother absolutely, but if she dies before him then to you two equally.
Or it might be given to her upon trust for the two of you.
Either way you cannot be guessing. The actual wording needs to be looked at.

You really need to have a close look at the Will, but what you say suggests that your mother inherits everything, with you and your sibling sharing equally if your mother is not alive to inherit. If I am right, your mother may be suggesting a variation of the terms of the will.

Thanks both. I didn’t get a good look at the wording and wish I had taken a copy or a photo. Hopefully I’ll get another look
        at it. Thanks!
